Privacy Policy for FedPlanPro by VINJONES, LLC

This Privacy Policy (the “Policy”) explains how VINJONES, LLC (“VINJONES,” “we,” or “our”) collects, uses, stores, and safeguards personal information through the FedPlanPro platform (https://FedPlanPro.com and https://FedPlan.Pro). FedPlanPro is a software-as-a-service product designed to help federal employees, financial professionals, HR staff, and similar users analyze retirement data and related financial information.

VINJONES is committed to maintaining the confidentiality and security of user data in accordance with applicable federal and Washington State privacy laws. The Platform is intended solely for users aged 18 and older.

This Policy shall be effective as of the Effective Date above and shall remain in effect until superseded or terminated pursuant to any future amendments or applicable law.

Use of the Platform constitutes your acceptance of this Policy and consent to VINJONES’ collection and use of Personal Information as described herein.


1. Introduction And Scope
This section outlines the scope of this Policy and the users it applies to. The Policy applies to all users (collectively “Users” or “you”), including but not limited to federal employees, financial professionals, HR staff, back-office assistants, and agencies who engage with the FedPlanPro platform through its official URLs (https://FedPlanPro.com and https://FedPlan.Pro). This Policy governs the collection, use, safeguarding, and disclosure of personal information gathered through the Platform as of the Effective Date and applies uniformly to all user types. VINJONES does not process or store data on behalf of federal agencies but solely for individual Users accessing the services for retirement data analysis and financial planning. The Policy delineates the responsibilities of VINJONES and the rights of Users concerning their personal data within the scope of the Platform’s operations. VINJONES provides its services to Users in a business-to-business or informational capacity and does not act as a fiduciary, advisor, or agent of any User.


2. Information Collected
VINJONES collects certain limited Personal Information necessary to operate and improve the FedPlanPro platform and to ensure compliance with privacy standards and safeguard user data effectively. Personal Information collected may include the following:

a. Names: As part of user profile creation and identification.

b. Email addresses: Used for account management, communication, and notifications regarding the platform.

c. Phone numbers: Utilized for contact and verification purposes.

d. Company names: For professional identification and association with user accounts.

For federal employees using FedPlanPro for retirement and financial planning, financial data such as income, retirement account details, and relevant financial metrics are collected. Please note that FedPlanPro does not collect Social Security Numbers (SSNs) from any user. VINJONES is committed to collecting only the data necessary to provide efficient and secure services to users.

VINJONES does not intentionally collect sensitive information (such as health data or government identifiers) and disclaims responsibility for such information if entered by Users.


3. Purpose And Use Of Collected Information
We collect user information to enhance and optimize the FedPlanPro platform’s functionality for federal employees, financial professionals, HR staff, and back-office assistants. The information is used to allow users to input, analyze, and manage retirement data efficiently. Specifically, we use Personal Information to provide personalized features and content, deliver tailored services, and improve user experience on the platform. VINJONES may also use aggregated or de-identified data for internal analytics, research, and product development purposes. This includes but is not limited to: creating and managing user accounts, processing data for retirement analysis, facilitating communication between users and support teams, and generating aggregated data insights to refine our services. Furthermore, collected information assists us in maintaining platform security, complying with legal obligations, and enforcing our terms of service. VINJONES does not make automated decisions or profiling that produce legal effects for Users. VINJONES may also retain transaction or usage logs for internal auditing, troubleshooting, and fraud-prevention purposes.

4. User Responsibility and Limitation of Liability
Users are solely responsible for the accuracy, completeness, and legality of the data they input into the FedPlanPro platform. VINJONES does not verify, validate, or guarantee the correctness of user-supplied data. Analytical results or outputs generated by the platform are dependent on the accuracy of the information provided by Users. VINJONES shall not be liable for any errors, omissions, or inaccuracies in analysis, recommendations, or reports that arise from incorrect or incomplete data entered by Users. Users acknowledge and accept that it is their responsibility to ensure all submitted data is accurate and up to date.

VINJONES provides its Platform ‘as is’ and without warranty of any kind, whether express or implied, including without limitation warranties of accuracy, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, VINJONES total liability arising from or related to this Policy or the Platform shall not exceed the total fees paid by the User, if any, during the six (6) months preceding the claim.

5. Legal Basis For Data Processing
At VINJONES, the legal basis for processing your Personal Information is grounded in compliance with Applicable Law. Our processing activities primarily rely on the necessity of the data for the performance of a contract, such as providing services through the FedPlanPro platform to individuals, financial professionals, agencies, and HR staff. VINJONES processes Personal Information as necessary to perform its contractual obligations, comply with applicable laws, and pursue its legitimate business interests, including maintaining the security, integrity, and functionality of the Platform.


6. Data Hosting And Storage
User data is hosted in the United States using Amazon Web Services (AWS), a reputable third-party provider. VINJONES relies on AWS’s security certifications and maintains commercially reasonable administrative, technical, and physical safeguards. Access to user data is restricted to authorized personnel who require such access for operational or security purposes.

VINJONES does not share, process, or store user data with any other third-party vendors or service providers for hosting or processing purposes.


7. Data Safeguarding And Security Measures
To safeguard user data and restrict data access, FedPlanPro by VINJONES implements stringent security measures. Our data is securely stored on AWS databases, which are known for their robust security protocols and reliable infrastructure, as detailed in Section 6: Data Hosting and Storage. Access to user data is limited to authorized personnel who require such access for operational or security purposes. Furthermore, we adhere to the principle of data minimization by collecting only the minimum necessary user data, as outlined in Section 2: Information Collected.

We employ industry-standard encryption to protect data both in transit and at rest, ensuring that user information remains secure during transmission and storage. Regular audits and security assessments are conducted to identify and mitigate potential vulnerabilities promptly.

In addition, our platform is designed with role-based access controls and multi-factor authentication to prevent unauthorized access. All employees with access to sensitive information undergo rigorous background checks and security training to maintain the highest standards of data protection.

Through these comprehensive measures VINJONES is committed to maintaining the integrity, confidentiality, and availability of user data.


8. Data Retention
VINJONES retains Personal Information for as long as it is necessary to fulfill the purposes outlined in this Policy, including maintaining the integrity of the FedPlanPro platform and complying with legal obligations. The retention period for Personal Information is determined based on the following criteria: a) the duration of the user’s active account status and usage of the FedPlanPro platform, b) the necessity to comply with legal and regulatory requirements, and c) the need to resolve disputes, enforce agreements, and maintain accurate business and financial records. Once Personal Information is no longer required for these purposes, it may be deleted, anonymized, or otherwise disposed of in accordance with VINJONES’ data retention practices. In the event that it is discovered an underage user has registered in violation of our Age Restriction and User Eligibility policy, their account and data will be immediately removed. Additionally, users have the right to request deletion of their personal information as per Section 11: User Rights: Access, Correct, and Delete Data.


9. Data Sharing And Disclosure
At VINJONES, we take your privacy seriously and do not disclose your Personal Information, nor the personal information you enter into FedPlanPro, to third parties outside of the circumstances described herein. Our data-sharing and disclosure practices are as follows:

a. Legal Requirements: We may disclose your information if required to do so by law or in good faith belief that such action is necessary to comply with legal obligations, including but not limited to compliance with legal process, such as a court order, subpoena, or regulatory request, or to cooperate with law enforcement or other government authorities as permitted by law.

b. Protection of Rights: We may disclose your information when we believe it is necessary to protect and defend our rights and property, including enforcing our agreements and policies.

c. Safety and Security: We may share data when needed to protect the safety, security, or integrity of our users, employees, third-party service providers, or the general public.

d. Business Transfers: In the unlikely event of a merger, acquisition, reorganization, bankruptcy, or sale of assets, user information may be transferred or disclosed as part of that transaction, but this Privacy Policy shall continue to govern such information.

VINJONES does not sell, trade, or otherwise transfer your Personal Information, nor the personal information you enter into FedPlanPro, to outside parties. We are fully committed to ensuring that your data remains secure and confidential, reflecting our adherence to applicable laws and this Privacy Policy.

Except for AWS, which provides database hosting services, VINJONES does not share user data with any other third parties for processing, storage, or hosting. Disclosure of user data to other parties occurs only as required by applicable law, in response to legal process, to protect VINJONES’ rights, or in connection with business transfers described herein. These disclosures are strictly limited and do not include sharing user data for hosting or processing purposes outside AWS.


10. User Rights: Access, Correct, And Delete Data
Users of FedPlanPro by VINJONES have the right to request access to their Personal Information, request corrections to any inaccuracies, and request the deletion of their Personal Information. To exercise these rights, users may contact VINJONES via the contact information provided in the ‘Contact Information and User Inquiries’ section of this policy. Requests to access, correct, or delete Personal Information may be submitted to [privacy@vinjones.com]. VINJONES may decline or limit requests that are unreasonable, repetitive, or inconsistent with legal obligations. Upon receiving a request, VINJONES will take reasonable steps to verify the identity of the requester and may require additional information to process the request. Users should note that certain data may be exempt from deletion if it is necessary for continuing the services, for legal compliance, or for other legally permissible purposes. Further, VINJONES may be unable to delete information contained in legal, financial, or security records retained in accordance with its obligations.
VINJONES is not responsible for information retained in automated backup or archival systems.


11. Data Breach Notification
In the event of a Data Breach, VINJONES is committed to promptly notifying all impacted users to mitigate potential risks and harm. To this end, the following procedures will be observed:

a. Notification Timeline: Impacted users will be notified as soon as reasonably practicable, consistent with VINJONES’ assessment of the nature and scope of the incident. This expedited notification aims to ensure users can take immediate actions to protect their information.

b. Method of Notification: VINJONES will notify users via email, using the email address provided by the user at registration. Additional methods of communication may be employed as deemed necessary to ensure timely and effective notification.

c. Content of Notification: The notification will include:
– The date and nature of the Data Breach.
– The categories of Personal Information that were compromised.
– Steps taken by VINJONES to address the breach and mitigate its effects.
– Recommended actions users should take to protect themselves.
– Contact information for further inquiries and assistance.

d. Regulatory Compliance: VINJONES will comply with all Applicable Laws and relevant regulations, including Washington State’s data breach notification rules, as outlined in Section 13: Compliance with Laws.

e. Continuous Monitoring and Updates: VINJONES shall provide ongoing updates to users regarding the resolution of the breach and any revised recommendations for personal data protection.

Notification of a security incident shall not be construed as an admission of fault or liability by VINJONES.


12. Compliance With Laws
VINJONES complies with applicable federal and Washington State privacy and data security laws and continuously reviews and updates its practices to maintain compliance, thereby safeguarding user information and rights as outlined in Section 4: Legal Basis for Data Processing.


13. No Affiliation With Government Or Third Parties
VINJONES, the owner and operator of the FedPlanPro platform, disclaims any affiliation, connection, or endorsement with or by the U.S. Government. The platform is not connected to or endorsed by any federal agency, and the data processed or stored by VINJONES through FedPlanPro is solely for the benefit of individuals who use the platform. Additionally, VINJONES maintains no formal relationships with third-party entities beyond those outlined in Section 8: Data Sharing and Disclosure, ensuring that users’ personal data is neither shared nor disclosed to external parties without their explicit consent. Any references to federal programs or data models within the Platform are for informational and analytical purposes only.


14. Changes To This Privacy Policy
VINJONES reserves the right to amend this Privacy Policy at its sole discretion and at any time. Any changes to this Policy will be effective upon posting the revised Policy on the FedPlanPro platform. Users will be notified of significant changes through the contact information provided or via an announcement on the platform prior to the changes becoming effective. Users are encouraged to review this Policy periodically to stay informed about any modifications. Continued use of the FedPlanPro platform after any changes constitutes acceptance of the revised Policy.


15. Governing Law
This Policy is governed by the laws of the State of Washington, without regard to its conflict of laws principles. Any disputes arising under or in connection with this Policy shall be subject to the exclusive jurisdiction of the state and federal courts located in Washington State.
